By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorized access to other users' accounts, our servers, or systems
• Exploit bugs or glitches for unfair advantage instead of reporting them
• Use our Services for any illegal, fraudulent, or unauthorized purpose
• Interfere with or disrupt the integrity or performance of our Services
• Engage in real-money trading of accounts, characters, or in-game items outside of our authorized systems
• Reverse-engineer, decompile, or disassemble any part of our Services

Violation of these rules may result in temporary or permanent suspension of your account, forfeiture of in-game assets, and other actions we deem appropriate.

5. NFTs, Virtual Items, and Digital Assets

5.1 Virtual Items

Our Game may include virtual items such as skins, characters, equipment, and other in-game assets ("Virtual Items"). Virtual Items have no real-world monetary value and are licensed, not sold, to you. We retain all right, title, and interest in Virtual Items.

5.2 NFTs (Non-Fungible Tokens)

Certain Virtual Items may be represented as NFTs on a blockchain. When you acquire an NFT through our Services:

• You own the NFT token itself as recorded on the blockchain
• You receive a limited, non-exclusive license to use the associated digital artwork within the Game and for personal, non-commercial purposes
• We retain all intellectual property rights to the underlying artwork, designs, and game assets
• NFT ownership does not grant you any rights to trademarks, copyrights, or other intellectual property of Imaginus

5.3 Transactions and Risks

All blockchain transactions are final and irreversible. You acknowledge and accept the following risks:

• Cryptocurrency and NFT values are highly volatile and may fluctuate significantly
• Blockchain transactions require network fees (gas fees) that are not controlled by us
• You are solely responsible for the security of your wallet and private keys
• Lost or stolen private keys cannot be recovered by us
• Smart contracts may contain bugs or vulnerabilities despite auditing
• Regulatory changes may affect the legality or availability of digital assets in your jurisdiction

6. Purchases and Payments

Certain features of our Services may require payment. All purchases are final unless otherwise required by applicable law. We reserve the right to change pricing at any time.

In-app purchases made through app stores (Apple App Store, Google Play Store) are subject to the respective store's terms and refund policies.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, artwork, character designs, animations, music, sound effects, software, and game mechanics, are owned by Imaginus Inc or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on our content without our prior written consent.

8. User Content

You may have the opportunity to submit, post, or share content through our Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display your User Content in connection with our Services.

You represent that you own or have the rights to share any User Content you submit and that it does not violate any third-party rights or applicable laws.

9. Third-Party Platform Integrations

Our Services may integrate with third-party platforms, including but not limited to TikTok, to provide social features and community content for our players. By using these features, you agree to the following:

9.1 TikTok Integration

Our Website may display TikTok content created by the Imaginus player community, including gameplay highlights, fan-made tutorials, and creative content related to the Game. This integration is subject to TikTok's Terms of Service and Privacy Policy.

9.2 User Responsibilities

When using third-party platform features through our Services, you agree to:

• Comply with the terms and policies of the respective third-party platform
• Ensure that any content you share through our Services to third-party platforms complies with applicable laws and community guidelines
• Not use third-party platform integrations to harass, spam, or distribute unauthorized content
• Acknowledge that your interactions with third-party platforms are governed by their respective terms and privacy policies

9.3 Content Licensing

Third-party platform content displayed on our Website remains the property of its respective creators and is subject to the licensing terms of the originating platform. We do not claim ownership of user-generated content from third-party platforms. 9.4 Availability

We make no representations or warranties regarding the value, transferability, or utility of any NFTs or digital assets.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Imaginus Inc, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Loss of or damage to digital assets, NFTs, or cryptocurrency
• Service interruption or inability to access the Services
• Unauthorized access to or alteration of your data
• Any conduct or content of any third party on our Services

Our total aggregate liability for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Imaginus Inc and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

13. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We may also update game content, features, and balance at our discretion.

We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our Services will cease immediately.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Seychelles, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of an internationally recognized arbitration institution. The seat of arbitration shall be in the Republic of Seychelles, and the language of arbitration shall be English.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Imaginus Inc.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
